KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to release imported consignment of sweet corn, conned pine apple after securing differential amounts on the shape of bank guarantee/ pay order on a constitutional petition filed by M/s Bismillah Store.
On February 3 2022, during the hearing, counsel for the petitioner appeared before the bench and moved urgent application, he states that matter in on urgent basis, therefore, court may grant urgency.
After the hearing, court granted urgency and passed interim order that “learned counsel states that the petitioner has imported consignment of sweet corn, conned pine apple, in view of the facts and circumstances of the case, we directed the customs authorities to release the goods imported by the petitioner subject to the condition with the petitioner will deposit undisputed amount within seven days and with regard to disputed amount postdated cheques with endorsement from the banker clearance for payment with the nazir. with these directions this petition disposed of along with listed application”.
Earlier, counsel for the petitioner argued that petitioner had imported above mentioned goods according to law and filed goods declaration after fulfilment of all legal requirement, however, customs officials detained the same and demanded higher valuation without justification.
Citing Chairman Federal Board of Revenue, Director General of Valuation, Director Valuation, Collector of Customs Appraisement & Facilitation East as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
Petitioner further pleaded the court to direct them to release petitioner’s imported goods as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
