KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to release consignment imported by M/s International Brands Distribution on the shape of pay order/ bank guarantee.
On 14 December 2021, during the hearing, Iftikhar Advocate for petitioner, Kafeel Ahmed Abbasi deputy attorney general, Hussain Bohra assistant attorney general and Khalid Rajpar advocate appeared before the Court.
After the hearing, the court passed an order that “ urgency granted, to which no question of importability is attached, learned counsel has challenged the assessment alert, however, that one is to be decided once the para wise comments are filed.
The petitioner at this point of time seek release of consignment on securing the differential amount, however, apparently there is a dispute as to what assessment would apply to calculate a different amount. The amount alert has a few categories of “quaker oat Meal” such as Indonesian, Malaysian and Sri Lankan Origin and the other brand countries come in the “other category” of brands.
To Indonesia, Malaysian and Sri Lankan brands, the amount alert has been given a discount of 20% which comes to US$ 1.55 kg for its original price of US$ 1.95 kg, the consignment of the petitioner does not belong to Indonesia, Malaysian and Sri Lankan make, hence apparently it would come the other category of brands.
Differential amounts as such be secured with the Nazir of this Court through pay order on or bank guarantee, on securing such amount, the certificate be issued for the release of the petitioner’s consignment”.
