SHC directs to release consignment imported by M/s Nishat Power Limited on bank guarantee/ pay order

KARACHI: A two-member bench of the Sindh High Court headed by Justice Irfan Sadat Khan has directed customs department to release consignment of spares/ consumables after securing differential amounts on the shape of bank guarantee/ pay order on a constitutional petition filed by Nishat Power Limited

On 21 March 2022 during the hearing, Majid Jahangir Advocate appeared on behalf of the petitioner and argued that the petitioner has recently imported above mentioned goods and after all the formalities, petitioner filed goods declaration according to law.

He added that petitioner approached customs officials and requested them to release the same, however, customs officials did not consider petitioner’s request.

After the hearing, court passed an order that in view of the facts and circumstances of the case, we directed the customs authorities to release the goods imported by the petitioner subject to the condition with the petitioner will deposit undisputed amount and with regard to disputed amount postdated cheques with endorsement from the banker clearance for payment with the nazir.

Citing Chairman Federal Board of Revenue, Director General of Valuation, Director Valuation, Collector of Customs e Appraisement East as respondents, petitioner pleaded the court that act of the respondents is illegal, mala fide and arbitrary as well as may direct them to release petitioner’s imported goods as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
