SHC directs to release consignment imported by M/s Shinwari Global Enterprises on bank guarantee

KARACHI: A two-member bench of the Sindh High Court headed by Justice Irfan Sadat Khan directed customs department to release consignment of table ware, porcelain ware, dinner set cup & saucer, tea set, plastic mug etc after securing of differential amounts on the shape of bank guarantee/ pay order on a constitutional petition filed by M/s Shinwari Global Enterprises.

On 11 March 2022 court heard the matter and passed directions that “in view of the facts and circumstances of the case, we directed the customs authorities to release the goods imported by the petitioner subject to the condition with the petitioner will deposit undisputed amount within seven days and with regard to disputed amount postdated cheques with endorsement from the banker clearance for payment with the nazir with these directions this petition disposed of along with listed application”.

Earlier, counsel for the petitioner argued that petitioner has imported above mentioned goods and filed goods declaration according to law, however, goods are being assessed under the garb of valuation ruling 1602/ 2022 and enhanced valuation from US$ 0.90 to 1.60 kg.

Citing Chairman Federal Board of Revenue, Director General of Valuation, Director Valuation, Collector of Customs Model Appraisement & Facilitation East as respondents, petitioner pleaded the court that act of the respondents is illegal, mala fide and arbitrary as well as may direct them to release petitioner’s imported goods as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
