KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials to release consignments of imported computer USB data cable net etc subject to payment of all duties and taxes and others charges etc on a constitutional petition filed by Muhammad Aqeel Pingh, Muhammad Aqeel of M/s A R Industries, Muhammad Siddiq, proprietor of M/s Patanwala Traders, Rehmat, Muhammad Adnan, Mudassar Hussain and others.
On 3 August 2021, during the hearing, counsel for the petitioners completed their arguments and after their arguments, court directed customs officials that “let all the consignments be released to the petitioner’s subject to payment of all duties and taxes and other charges etc”.
It needs to be mentioned here that Collector Customs Appraisement East had submitted a first information report (FIR) against Muhammad Aqeel of M/s A R Industries, Muhammad Siddiq, proprietor of M/s Patanwala Traders, Rehmat, Muhammad Adnan, Mudassar Hussain and others, who were nominated for mega mis-declaration scam.
Investigation officer submits that on an actionable information, the consignment of the above mentioned accused persons was subjected to re-examination jointly with R&D team, quantities were found changed in almost all the items of the consignment.
He further informs the court that in first examination, description and quantity was reported as computer USB data cable net weight 900 kg approx., upon re-examination, the description and quantity was confirmed as mobile data charging cable net weight 2000 kgs approx.
investigation officer added that during the investigation, it was established that the accused persons with active connivance of his clearing agent and others associates, have deliberately mis-declared description, quantity and value of the impugned goods with the intent to get illegal clearance of the same at mis-declared and under-invoiced value and evaded legitimate government revenue to the tune of Rs2,620,809. First information report is lodged accordingly for in-depth investigation into the matter and to unearth the actual culprits involved in an attempt to evade legitimate duty.
