KARACHI: The Sindh High Court (SHC) directed customs officials to release of the consignments subject to securing the disputed amount of duty and taxes before the concerned Collectorate in the shape of pay order/ bank guarantees in accordance with law on a petition filed by M/s M. Usman seeking release order of its consignments of polyester yarn detained by customs officials due to disputed valuation.
On March 26, 2019, counsel for the petitioner stated that petitioner imported consignments of polyester yarn and filed Goods Declaration (GDs) according with law @ $1.49 per kilograms.
Counsel further argued in his petition that the petitioner is seriously aggrieved and highly prejudiced by the actions of the collector of customs, Collectorate of Appraisement East, whereby the said respondent and collector of customs MCC, Appraisement West have denied to accept the declared transaction value of the imported consignments of polyester yarn and assessed the duty and taxes on the basis of Valuation Ruling No 1355/2018 dated 15/03/2018 @$1.59 per kilogram.
Citing chairman Federal Board of Revenue, collector Appraisement East, collector of customsAppraisement West and Director General of Customs Valuation as respondents, court may please to declare that denial of allowing provisional release of the impugned consignments disregarding/ disobeying the orders of this court and direct them to release its consignments immediately.
