SHC directs to release detained consignment on petition filed by M/s Dollar Industries Private Limited

KARACHI: A two-member bench of the Sindh High Court headed by Justice Irfan Sadat Khan directed customs department to release consignment of imported ink, foundation pens, ball points, pen, pencils, pointer, markers, coloring set etc after securing of differential amounts on the shape of bank guarantee/ pay order on a constitutional petition filed by Dollar Industries Private Limited.

On 12 March 2022 during the hearing, counsel for the petitioner Salahuddin Ahmed appeared before the court and moves urgency which was accepted by the court, after his argument, court passed an order that learned counsel states that the petitioner has recently imported above mentioned goods and the said consignment may be released as done perversely.

The petitioner under the circumstances is directed to deposit the undisputed amount with the customs authorities within three days’ time and so far as the disputed amount are the concerned, he should furnish bank guarantee along with copy of the goods declaration in nazir of this court and after that consignment should be released as per directions.

Earlier, counsel for the petitioner argued that petitioner imported above mentioned goods and filed goods declaration according to law, however, customs officials are assessing valuation under the garb of impugned SRO 840 (I) 2021 & SRO 903 (i) illegally.

Citing Chairman Federal Board of Revenue, Director General of Valuation, Director Valuation, Collector of Customs Appraisement East as respondents, petitioner pleaded the court that act of the respondents is illegal, mala fide and arbitrary as well as may direct them to release petitioner’s imported goods as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
