SHC directs to release goods imported by M/s Friesland Compina Engro Pakistan Ltd

KARACHI: A custom appellate bench of the Sindh High Court (SHC) directed customs authorities to release goods imported by M/s Friesland Campina Engro Pakistan Limited after receiving differential amount of duty and taxes.

Kashif Nazeer Advocate Deputy Attorney General represented the federal government while respondent custom collectorate was represented by Sardar Zafar Hussain Advocate.

During the hearing of the case Salman Aziz Advocate, counsel for the petitioner company who said that company has challenged four different assessment orders before the Collector (Appeals) whereby classifying the goods under HS Code 3824.9999 chargeable to custom duty at a rate of 3 per cent but such assessment was declined and assessment was made under HS Code 2106. 9040 and 9090 chargeable to custom duty at a rate of 20 per cent.

He further argued that consignments are stuck at port incurring port charges and in view of such a situation, petitioner is willing to secure the differential amount of duty and taxes.

The bench allowed the request disposing off the petition with direction that appeal of the petitioner be decided as per law and till such time when a final order is passed, the security furnished shall not be encashed.
