KARACHI: A two-member bench of the Sindh High Court (SHC) dismissed a constitutional petition as not pressed filed by M/s Quick Contractors and Traders seeking release order for imported crane for construction use seized by customs officials due to allegedly violation of import policy.
On 5 March 2022, a two-member bench, headed by Justice Irfan Sadat Khan heard the matter, during the hearing, Imran Iqbal Khan appeared before the court and request for dismissal as not pressed, therefore, after the hearing, court dismissed the same as not pressed.
Earlier, counsel for the petitioner states in his constitutional petition that during the course of business, petitioner has imported 3 cranes for construction use and after all the legal formalities, petitioner filed goods declarations and requested customs officials for release the same.
He added that however, petitioner was shocked when he was informed by the officials of the customs department that above mentioned consignment has been seized and allegation was fixed that petitioner has imported old and used truck which is hit by section 9 (5) of the import policy order, 2015.
He submits that after issuing a show cause notice, petitioner approached customs appellant tribunal seeking release order and tribunal allowed the appeal and directed customs officials to release the same, however, customs officials are not complying tribunal order which is violation of law.
Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement West and others, petitioner pleaded the court to declare that act of the respondents is unlawful, mala fide and arbitrary.
He also pleaded the court may set aside impugned show cause notice and directed them to release the same as well as restrain them from taking any adverse action against the petitioner till final order in this constitutional petition.
