KARACHI: A two-member bench of the Sindh High Court (SHC) has dismissed special customs reference application filed by Collector of Customs Appraisement East against M/s Power Solution Lahore.
On 29 December 2021, during the hearing, counsel for the applicant argued that respondent M/s Power Solution Lahore has imported 3 units 3 phase voltage stabilized 3200 KVA (Cirrus) Orta Torad New Power Factor Correction System PFL System (Cirrus) 3 PH Volt Stabile 3200 KVA Dinensim 3600&1400&2150MM Serial No 504301 of Italian origins US# 2, 814,688 and filed goods declaration (GD).
Counsel added that after the examination, Customs officials issued imported notice for additional amount due to disputed valuation, instead of payment, importer moved customs appellant tribunal and tribunal granted importer’s application without consideration facts and lawful grounds.
Citing Power Solution as respondents, applicant pleaded the court may set aside impugned order passed by customs appellant tribunal dated July 10, 2017 n CA-K 223/2016/241 and restore the customs’ demand notice.
However, a two-member bench of the Sindh High Court (SHC) declared that no illegality has found in customs appellant tribunal’s order, therefore, special customs reference application is dismissed along with all pending applications.
