SHC dismisses stay petition filed by M/s Master Pipe Industries as not pressed

KARACHI: The Sindh High Court (SHC) dismissed a stay order as not pressed filed by Nisar Ahmed proprietor of M/s Master Pipe Industries against imposition of regulatory duty on import of flate rolled products of iron on non-alloy steel under valuation ruling no 840 (i)/ 2021.

On 28 March 2022, during the hearing, Muhammad Adeel Awan advocate for petitioner, Muhammad Khalil Dogar advocate for customs officials appeared before the court.

During the hearing, counsel for the petitioner, does not press instant application (stay order), same the dismissed as not pressed, court called arguments for parties and adjourned the hearing for next date of hearing.

Earlier, counsel for the petitioner appeared before the court and submitted that petitioner is engaged in the lawful business of import and fulfils all the responsibilities according with law.

He argued that his client imported above mentioned goods and filed goods declaration according with law, however, it is seriously aggrieved from act of the respondents who imposed extra duty on the same without lawful authorities and adopting legal manners.

After the hearing, court had issued notices to the customs officials and deputy attorney general of Pakistan and directing them to file comments on next date of hearing

Citing Chairman Federal Board of Revenue, Chief Collector of Customs South, Collector of Customs West, Collector of Customs Port Muhammad Bin Qasim and Director General Valuation as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary, he also pleaded the court may restrain them from taking any coercive action till final order in this petition.

He further pleaded the court may restrain them from taking extra duty on its consignment.
