SHC disposes of Muzammil Enterprises’ petition against suspension of sales tax registration

KARACHI: The Sindh High Court (SHC) has disposed of a petition filed by M/s Muzammil Enterprises against suspending his sales tax registration on not filing the sales tax returns for 58 months, as the petitioner did not want to pursue the case further.

During the hearing, counsel for the petitioner submitted that grievance of the petitioner has been resolved and he did not want to proceed further.

A two-member bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi heard the petition and disposed it of.

Earlier, the petitioner’s counsel stated that petitioner was registered as importer/manufacturer and general-order supplier and contractor of different items. He paid all the duties regularly.

According to the importer, however, respondents issued a notice on April 12, 2013 in which it was alleged that petitioner profile was suspected due to not filing the sales tax returns for 58 months during tax year 2002 to 2008.

The counsel argued that show cause notice was never issued to him so that it could know that the sales tax returns were not filed.

Citing Ministry of Finance secretary, FBR chairman, RTO-I Inland Revenue (IR) chief commissioner, IR commissioner and others as respondents, the petitioner had pleaded the SHC to set aside impugned notice.
