KARACHI: The Sindh High Court (SHC) has issued bailable warrants of a suspect, Ahmed Muhammad, who had challenged the impugned judgment of the Special Judge (Customs & Taxation) Karachi which had sentenced him to five years imprisonment and a fine of Rs 100,000.
A single-member bench, comprising Justice Muhammad Iqbal Kalhwar, heard the appeal of the applicant. However, when the matter came up before the court for hearing of the case, the applicant was called absent. The court issued bailable warrants against him in the sum of Rs 50,000.
The court directed the SHO customs collectorate, customs house Karachi to produce the accused/applicant before the court on October 13, 2016. The court further directed that the “if the said accused shall give bail himself in the sum of Rs 50, 000 to appear before this court on October 13, 2016 and contain so to attend this court until otherwise directed by this court, he may be released”.
According to the prosecution, Special Judge (Customs & Taxation) Karachi Salman Ansari passed order dated May 20, 2004 and convicted the same to five years imprisonment and to pay fine of Rs100,000 and in default of payment of fine the accused shall undergo further imprisonment for a period of one year in a case of mis-declaration as case no 118/1994, under section 156 (1) (8) of the customs act 1969.
Accused/ applicant had challenged that impugned judgment of the custom court Karachi and pleaded the SHC may set aside of impugned judgment, after filing appeal, SHC had granted him to bail in a sum of Rs. 100,000, however, after getting bail, accused/applicant is not appearing before SHC in last several hearings.
