SHC issues contempt notice to CIR on petition filed by M/s Surge Laboratories

KARACHI: A two-member bench of the Sindh High Court (SHC) issued contempt notice to commissioner inland revenue zone-I, large taxpayer unit-II and called him in person for next date of hearing, on a constitutional petition filed by M/s Surge Laboratories importer of a vast variety of pharmaceutical products.

On 21 September 2021, a two-member bench, headed by Justice Shafi Muhammad Siddiqui heard the matter.

After the hearing, court passed order and mentioned that “initially the Show cause notice dated March 30, 2016 was taken into consideration by the CIR appeals and proceedings ended, declaring that the notice as nullity void ab-unitio and was set aside, despite such observations of the CIR, apparently a contemptuous notice is repeated in addition to some more period which itself would not be enough to overcome the findings of the CIR, which in any case was not challenged.

This is an apparent contempt and amounts to flouting the observations of a judicial forum, the officer is in attendance issuing the aforesaid contemptuous notice, he is directed to file an affidavit explaining the reasons in a weeks’ time and appear in person on the next date of hearing.

Petition filed a constitutional petition and cited Chairman Federal Board of Revenue, Commissioner Inland Revenue Zone-I, Large taxpayer Unit-II and Assistant Commissioner Inland Revenue Zone-I, Large taxpayer Unit-II and informs the court that petitioner is engaged in lawful business import of raw material for local manufacture and local supply of vast variety pharmaceutical products. However, respondents issued income tax related notices which are unlawful and have no legal effect.
