SHC issues notice to M/s Sky Electric Private Limited on SCRA filed by Collector Appraisement West

KARACHI: A two-member bench of the Sindh High Court (SHC) issued notice to M/s Sky Electric Private Limited on a special customs reference application filed by Collector of Customs Appraisement West against appellate tribunal order.

On 1 November 2021, during the hearing, counsel for the appellant argued that the above-mentioned importer has imported a consignment of connectors, bolts, washers and lithium iron battery cells through a clearing agent namely M/s U-Traders Logistics.

Counsel added that importer filed goods declarations after fulfillment of all the legal formalities and availing exemption for customs duty under table 1, serial no 23(8) (i) of table 3 0f the sixth schedule to the sales tax act, 1990 which was released the same.

He submitted that after an inquiry, customs officials issued a show cause notice for evasion of duty and taxes amounting to Rs3,680,735, however, importer moved appellate tribunal and tribunal has decided appeal in the favor of importer.

Citing M/s Sky Electric Private Limited as respondent, the applicant pleaded the court to declare that order passed by customs appellate tribunal is illegal and no legal effect and also may direct the importer to pay amounting to Rs3, 680, 735 for duty and taxes and penalty as well.

After the hearing, a two-member bench of the Sindh High Court (SHC) issued notice to M/s Sky Electric Private Limited and directed them to submit para wise comments on the next date of hearing.
