SHC issues notice to tax authorities on petition filed by jewellery exporter

ISLAMABAD: The Sindh High Court (SHC) has issued notices to the deputy collector of Customs, JIAP, collector of Customs Appeals Customs House Karachi, as well as deputy attorney General Pakistan on an appeal filed by Muhammad Iqbal, challenging a notice of Rs 48.137 million issued by Deputy Collector of Customs.

While hearing of the appeal a two-member bench comprising Justice Muhammad Iqbal Kalhoro and Justice Khadim Hussain M Sheikh also directed the respondents to submit their respective comments by August 8, 2016.

Earlier, counsel for the petitioner stated that petitioner is engaged in a business as AK Motiwalla Enterprises and exported 33 consignments of gold jewellery from Pakistan during the period from January 1, 2005 to Dec 31, 2009 under self-consignment scheme in terms of SRO 266 (1) /2001 on May 07,2001.

The applicant was bound to bring foreign exchange into country equal to the cost of gold used in manufacturing of jewelry along with value addition amount within 240 days from the date of export in terms of Clause 6 ( IV ) of the said SRO, however the applicant failed to do so within the stipulated period.

According to the applicant, the matter was adjudicated by the deputy collector customs Air Port Karachi on April 19, 2014 , wherein the said authority adjudged an amount of Rs 40.137 million against him and aforesaid order was upheld by the collector Appeals Karachi on September 17, 2014.

Citing the Deputy Collector of Customs, JIAP, Collector of Customs Appeals Customs House Karachi as respondents, the petitioner pleaded the SHC to set aside impugned orders as he maintained that it was without jurisdiction and without lawful authority. The court was further requested to transfer the case to the appellate tribunal with direction for hearing on merits of the case before passing any order.
