SHC issues notices on petition filed by M/s Trade Impex Marketing

KARACHI: The Sindh High Court (SHC) issued notices to customs department and deputy attorney general on a constitutional petition filed by M/s Trade Impex Marketing seeking release order of its imported consignment of woven fusible interlining ID 800 (black and white) seized by customs officials due to mis-declaration.

On October 31, 2019, a two-member bench, headed by Justice Aqeel Ahmed Abbasi also directed them to make ensure filing their para wise comments on next date of hearing.

During the hearing, counsel argued that petitioner purchased above mentioned goods which were packaged and shipped to the petitioner as a single consignment dated 27/08/2019 and filed goods declaration as per law, however, AC/DC Assessment Customs Collectorate Appraisement West seized its consignment illegally.

Citing secretary Revenue Division, the collector of Customs Appraisement West and AC/ DC Assessment Appraisement West as respondents, petitioner pleaded the court may to declare that no action detrimental to the interest of the petitioner can be taken on the basis of the assessment order dated 10/10/2019 passed by the respondents until the issue is adjudicated upon by at least one independent forum.

He further pleaded the court to direct the respondent to issue delay and detention certificate to the petitioner is terms of Section 14-A of the Customs Act, 1969.
