SHC moved against customs values of cell phones accessories

KARACHI: The Sindh High Court (SHC) has issued notices to the tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by M/s Abdul Aziz, challenging the Valuation Ruling No 908/2016, which enhanced the customs values of mobile phone accessories.

While hearing the petition, a two-member bench comprising Justice Munib Akhtar and Justice Saeeduddin Nasir also directed them to file their respective para wise comments on the next hearing i.e. October 7, 2016.

Earlier, counsel for the petitioner stated that it has imported a consignment relating to mobile accessories, including mobile head phones, etc. After arrival of the consignment, the petitioner filed goods declaration as per transaction value which was not accepted by the staff of the tax authorities.

The importer claimed that the said goods were arbitrarily assessed on enhanced values on the basis of impugned Valuation Ruling No 908/2016 dated August 12, 2016 which is issued in a manner contrary to law and regulations.

Citing Revenue Division sectary, Customs Appraisement-West collector and Customs Valuation director general and director as respondents, the petitioner pleaded the court may declare that demand of the additional duty and taxes without following the procedure laid down in section 25(A) is illegal void and of no legal effect.

The petitioner also pleaded the court may declare the valuation ruling as illegal and of no legal effect.
