SHC orders Customs to release consignments of solar/DC LED lights

KARACHI: The Sindh High Court has ordered immediate release of over a dozen consignments of solar/DC LED lights.

A SHC appellate bench, comprising Justice Munib Akhtar and Justice Zulfiqar Ahmed Khan, was hearing a petition filed by Aleem Enterprises and Jutt Lights, Karachi in which Secretary FBR, Port Muhammad Bin Qasim Collector, Engineering Development Board, Alternate Energy Development Board are cited as respondents.

Hyder Shaikh advocate of Franklin Law Associates appearing for the petitioners submitted that the GD was filed under PCT 9405.1090 and they availed the exemption under 5th Schedule of Customs Act 1969, 6th Schedule of Sales Tax Act 1990 (Entry 15) but the respondent Customs Collectorate is not releasing the consignments which have already landed at the port while others are arriving.

The bench after hearing arguments by Customs side ordered forthwith release of the consignments of the petitioners. The bench held that petitioner are entitled to the exemption claimed by them.
