Faisalabad Customs Intelligence collects evaded tax, release consignments

SHC orders release of consignment on payment of taxes

KARACHI: The Sindh High Court has ordered release of the consignments on payment of custom duty and other taxes

The SHC appellate bench, comprising Justice Munib Akhtar and Justice Arshad Hussain Khan, issued the order while hearing a constitution petition filed by Horizon International which imported Grey Fabric from Dubai.

The bench expressed anger over defiance of its order passed on previous date and asked a report that why consignment in dispute was not shifted to Common Pool Fund Bonded Warehouse. However, the department preferred an appeal against this order.

During the hearing, the bench also said that when apex court remanded back the case and when the allegation of Indian origin are not proved, the case must have been decided by the respondent Custom officials.

The petitioners/importers maintained that the fabric in dispute was of China origin and as per Bill of Landing (B/L) it was lawfully imported from Dubai’s free port. The customs disputed the same alleging that no company in China make the fabric.
