SHC orders to release consignment of used steam turbine

KARACHI: The Sindh High Court (SHC) has ordered provisional release of A.F Steel Re-Rolling Mills’ consignment of used industrial steam turbine.

The court directed the petitioner to deposit differential amount of duty and taxes with Nazir of the court.

Advocate Ghulam Nabi Shar, who represented the petitioner, submitted that his client has imported an old and used one unit complete steam turbine with alternator and standard accessories and sought its clearance when it arrived at the port on September 08.

The customs authorities examined the particulars of the consignment and observed that there is no mechanism to determine the value of used industrial steam turbine. Therefore, they applied the method used to determine the value of old and used generator sets and assessed the value of the petitioner’s consignment.

Aggrieved by the assessment, the counsel said, imported turbine falls within category of machines and classifiable under HS Code 8406.8100 and its value is assessed on the basis of its weight. The assessed value of the imported item is very high.

The petitioner requested the court to order the customs authorities to reassess the value of the consignment and order provisional release of his consignment.
