SHC orders restoration of M/s RK Shippers’ license

KARACHI: The Sindh High Court (SHC) has restored the license of a customs agent, M/s RK Shippers, Karachi, which was suspended by customs officials. A two-member bench, comprising Justice Munib Akhtar and Justice Umer Sial was hearing the petitioner.

During the hearing, the court directed the petitioner to submit surety of Rs 250,000 and nazir will issue an appropriate certificate and license of the petitioner will be immediately revived and restored as the customs agent.

Earlier, counsel for the petitioner stated that it has imported eight containers of ceramic tiles from China and filed goods declaration according to law. After assessment, the company paid duty and taxes as per Afghan Transit Trade and disposed of the same in Karachi. However, officials of the customs department lodged First Information Report (FIR) against petitioner and license was suspended by them without showing any lawful reason.

Citing Chief Collector of Customs, Additional Collector of Customs Collectorate West and chairman Federal Board of Revenue as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.

He also pleaded the court may direct them to restore its license immediately and restrain them from taking any coercive action till final order on this petition.
