SHC rejects petition filed by M/s Overseas Business Corporation

KARACHI: The Sindh High Court (SHC) dismissed petition as matter resolved on a constitutional petition filed by M/s Overseas Business Corporation seeking release order of its consignment of UK based Quaker Oats (easy to cook) imported from Dubai. A two-member bench, headed by Justice Munib Akhtar was hearing the petition.

During the hearing, court observed in its order that matter appears to have been resolved so the petition is dismissed as not pressed.

Earlier, counsel for the petitioner stated that it is lawful engaged in the business of import of UK based Quaker Oats (easy to cook) from Dubai for own sale and supply in Pakistan.

He further argued that it came to know, that petitioner’s consignment was blocked by wrong assumption of law and facts which are laying at Port Muhammad Bin Qasim, counsel informed that customs officials are demanding additional amount and refused the release of its consignment.

Citing Chairman Federal Board of Revenue, Customs Collectorate Port Muhammad Bin Qasim, Collector/ Directorate Adjudication as respondents, counsel pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

He also pleaded the court to direct them to release its consignment immediately and restrain them from taking any coercive action against the petitioner.
