KARACHI: The Sindh High Court (SHC) directed customs officials not to take any action against the petitioner till next date of hearing on a constitutional petition filed by Khalil-ur-Rahman seeking restraining order against auctioning his Jeep Toyota Surf bearing registration number BF-6328 seized by customs authorities.
While the hearing of petition, a two-member bench, comprising Justice Munib Akhtar and Justice Omer Siyal also issued notices to the customs officials and deputy attorney general directing them to file their respective para wise comments on next date of hearing.
Earlier, counsel for the petitioner stated in his constitutional petition that he is lawful owner of the Jeep Toyota Surf bearing registration number BF-6328 and purchased it after fulfillment of all the legal requirement and formalities, he submitted that customs officials seized his vehicle without shown any lawful reason and now it came to know to the petitioner that customs authorities are going to auctioning his Jeep Toyota Surf unlawfully and illegally.
During the hearing, court heard the arguments of the petitioner and restrained the customs authorities from auctioning his vehicle till further order.
Citing Secretary Ministry of Finance, Chairman Federal Board of Revenue, Collector of Customs Appraisement, Collector of Customs Preventive, Deputy Collector of Customs Anti-Smuggling Organization as respondents, he pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary, he also pleaded the court to restrain them from taking any coercive action against the petitioner including auctioning his vehicle till final order in this petition.
