KARACHI: The Sindh High Court (SHC) has issued notices to the tax authorities and deputy attorney general on a constitutional petition filed by Tahir Ramzan Qawish challenging enhanced valuation of his consignment of “glass tubing” at the $ 1.00/kg instead of 0.45/kg.
During the hearing of petition, a two-member bench, comprising Justice Munib Akhtar and Justice Saeeduddin Nasir directed the tax authorities to file their respective para wise comments on next date of hearing.
Earlier, counsel for the petitioner stated in his constitutional petition that petitioner is importer and exporter of various kinds of items relating to pharma industries but not linked to glass tubing from China and around the world.
Counsel informed the court that petitioner imported a consignment of glass tubing from China and filed goods declaration dated October 1, 2016 and declared the valuation accordance with law at $ 0.45/kg, however, during the examination he was informed by the officials of the tax authorities that respondents have rejected the said valuation and enhanced the valuing at the rate of $ 1.00/kg illegally. Counsel further argued that act of the respondents is illegal and unlawful.
Citing chairman Federal Board of Revenue (FBR), the Collector of Customs West Collectorate of Enforcement as respondents, petitioner has pleaded the court may declare impugned valuation as illegal, mala fide and unlawful.
Importer also pleaded the SHC may set aside impugned enhanced valuation and restrain the tax authorities from taking any coercive action against the petitioner.
