SHC seeks remarks from tax authorities on petition filed by Irfan Changhani

KARACHI: The Sindh High Court (SHC) has issued notices to the tax authorities and deputy attorney general on a constitutional petition filed by Irfan Changhani, seeking release order for a consignment of paper and plastic printed waste blocked by the Customs Department.

During the hearing of the petition, a two-member bench headed by Justice Munib Akhtar also directed them to file their respective comments on the next date of hearing. The court fixed the hearing for January 20, 2017.

Earlier, counsel for the petitioner stated that petitioner purchased paper and plastic printed waste through supplier Airlift (USA) Inc on behalf of Al Shaab Waseem Metals Crap Truae and filed goods declaration according with law.

According to the petitioner, after the fulfillment of all requirements, it approached the tax officials for release of its consignments, however, instead of releasing its consignment, officials of the Customs Department blocked the same without showing any lawful reason.

Citing Secretary Ministry of Finance, chairman Federal Board of Revenue (FBR), collector of Customs Model Customs Collectorate, DG Customs Intelligence and Investigations as respondents, petitioner pleaded the court to declare that act of the customs department is illegal, mala fide and arbitrary, he also pleaded the court may direct them for release consignment of the petitioner immediately.
