SHC seeks comments from tax authorities on case filed by M/s Abdul Aziz & Brothers

KARACHI: The Sindh High Court (SHC) has sought comments from tax authorities on a petition challenging valuation ruling no 908/2016 2016 which enhanced the values of mobile phone accessories.

A two-member bench comprising Justice Munib Akhtar and Justice Saeeduddin Nasir heard the constitutional petition and directed the tax authorities to file para wise comments. The petition was filed by M/s Abdul Aziz and Brothers, challenging the valuation ruling no 908/2016 dated 12/08/2016 which enhanced the values of mobile phone accessories.

During the hearing, counsel for the custom department sought time for submit para wise comments, therefore court granted time and directed the tax authorities to file respective on next date of hearing.

Earlier, counsel for the petitioner stated that it has imported a consignment relating to mobile accessories including mobile housing and mobile head phones and after arrival of the consignment filed goods declaration as per transaction value which was not accepted by the staff of the tax authorities.

According to the importer, said goods were arbitrarily assessed at on enhanced on the basis of impugned valuation ruling 908/2016 dated 12/08/2016 which is issued in a manner which is contrary to law and regulations.

Citing Sectary Revenue Division, the Collector of Customs Appraisement West Model Customs Collectorate, the Director of Valuation Directorate of Valuation and the Director General of Valuation, Directorate of Valuation as respondents, petitioner pleaded the court may declare that demand of the additional duty and taxes without following the procedure laid down in section 25(A) is illegal void and of no legal effect.

Petitioner also pleaded the court may declare that issue of the valuation ruling no 908/2016 dated 02/08/2016 is illegal and of no legal effect.
