SHC seeks comments from tax authorities on petition filed by Garibsons

KARACHI: The Sindh High Court (SHC) has issued notices to the tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by M/s Garibsons (Private) Limited against imposition of super tax.

While the hearing of the petition, a two-member bench headed by Justice Munib Akhtar also directed the tax authorities to file their para wise comments on the next date of hearing. The court adjourned the hearing for January 6, 2017.

Earlier, counsel for the petitioner stated that petitioner is a private limited company and it deals in rice exports and marketing of clipboards. The company is paying all liabilities regularly. The counsel argued that it filed total income for the tax year 2015 under section 114 of the Income Tax Ordinance 2001.

According to the importer, however, the tax authorities imposed super tax on the petitioner illegally. Citing Secretary Revenue Division, Commissioner Inland Revenue Zone-IV Large Taxpayer Unit, Deputy Commissioner Inland Revenue Zone-IV Large Taxpayer Unit as respondents, the importer pleaded the court to declare that act of the respondents as illegal and arbitrary. He also pleaded the SHC to declare the imposition of super tax as illegal, without lawful authority and of no legal effect.
