SHC seeks comments from tax authorities on petition filed by Hamza Sugar Mills

KARACHI: The Sindh High Court (SHC) sought comments from the customs tax authorities on a petition filed by M/s Hamza Sugar Mills Ltd seeking refund the entire amount of Rs. 252, 805, 582 being the special federal excise duty paid by the petitioner under section 3-A of the federal excise act, 2005 & SRO 655 along with mark-up thereon.  A two-member bench, headed by Justice Aqeel Ahmed Abbasi was hearing the petition.

During the hearing, counsel for the customs department requested some time for submit para wise comments, therefore, court granted time and directed it to file para wise comments on next date of hearing.

Earlier, counsel for the petitioner stated that petitioner approached the customs department for refund of his entire amount of Rs252.805 million being the special federal excise duty paid by the petitioner under section 3-A of the federal excise act, 2005 & SRO 655 along with mark-up thereon, however, officials of the respondents are not accepting his request.

Citing Chairman Federal Board of Revenue (FBR), Commissioner Inland Revenue Zone-II Large Taxpayer unit as respondents, petitioner pleaded the court may direct the respondents to refund entire amount immediately.
