SHC seeks comments from tax authorities on petition filed by M/s Continental Sweets, Bakers

KARACHI: The Sindh High Court (SHC) has directed the tax department to ensure that the petitioner shall be dealt with strictly in accordance with law on a constitutional petition filed by M/s Continental Sweets, Bakers, Nimco against forcibly removed and seized all the documents, including video recorder, boxes of records computer etc.

During the hearing of the petition, a two-member bench headed by Justice Aqeel Ahmed Abbasi also directed the tax department to file para-wise comments on the next date of hearing.

During the hearing, Amjad Jawaid Hashmi advocate sought time to file comments. However, counsel for the petitioner argued that court may direct the respondents not be proceed against the petitioner.

Earlier, counsel for the petitioner argued that on December 22, 2016 officials of the commissioner Inland Revenue, Zone-III carried unauthorized, unlawful, illegal and mala fide raid with the support of guards/police officer on its premises at Gulistan-e-Johar, Karachi and adopted extremely hostile action and forcibly taken away documents files, computers, electronic weighting scales without any explanation.

Citing Chairman Federal Board of Revenue, Chief Collector Inland Revenue, Regional Tax Office-III, the commissioner Inland Revenue, Zone-III and deputy commissioner Inland Revenue-III and others as respondents, the petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary and restrain them from taking any coercive action against the petitioner.
