SHC seeks comments in seized 40,000 litres of diesel case

KARACHI: The Sindh High Court (SHC) has sought comments from the deputy attorney general of Pakistan on a constitutional petition filed by M/s Fuel Traders seeking compliance order of the SHC for releasing its 40,000 litres light diesel oil.

A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain, was hearing the petition. During the hearing, the deputy attorney general sought further time for filing respective comments. The court granted the time and adjourned the hearing for August 23, 2016.

Earlier, counsel for the petitioner stated that petitioner is doing business of domestic trade of furnace oil, light diesel oil, high speed diesel etc. The petitioner being bona fide purchaser made domestic purchase of goods i.e 40,000 liters of light diesel obtained from breakable marine ships from the registered supplier M/s Huk Trading Co, the counsel stated, adding that a common oil tanker bearing Registration No K 8594 was hired by the petitioner on freight for transportation of its goods within the country from Karachi.

But during the transportation on Jan 01, 2016 ,the officers of the customs authorities intercepted the conveyance within the limits of Hyderabad and detained the goods along with transporting conveyance. The driver and cleaner were taken into the illegal confinement without adopting any legal procedure.

According to the petitioner, it filed a constitution petition before SHC and court had directed the respondents to release its goods; however, when petitioner approached the authority concerned for compliance the court order, they denied and it was informed that goods were being auctioned.

Citing above respondents, the petitioner pleaded the SHC may start contempt proceedings against the contemptuous.
