SHC seeks comments of Ferrous Engineering in Rs 2.1m tax evasion case

KARACHI: The Sindh High Court (SHC) directed has M/s Ferrous Engineering Industry to file para-wise comments on an appeal filed by Customs Appraisement-East law department additional collector against impugned order of the Customs Appellate Tribunal in a tax evasion case of Rs 2.186 million.

A two-member bench, comprising Justice Irfan Sadat Khan and Justice Muhammad Humayun Khan, was hearing the appeal. The court adjourned the hearing for November 30, 2016.

Earlier, counsel for the applicant stated in its appeal that importer electronically filed goods declaration dated March 20, 2014 and declared the consignment as hot dip galvanized steel of prime quality total weight of 151,170 kilogramme at the rate of $69,538.30. However, during the examination, goods were found hot dip colour steel sheet of secondary quality charging higher tariff rate 20 percent instead of 10 percent.

According to the applicant, importer attempted to deprive the state legitimate revenue amounting to Rs 2,186,125; therefore, show cause notice was issued to the said importer and authority concern also imposed Rs 200,000 fine to the importer, which being aggrieved, the importer filed an appeal before tribunal which was allowed and said tribunal reduced the fine without lawful authority.

Citing M/s Ferrous Engineering Industry as respondent, the applicant pleaded the court may declare that order of the tribunal illegal, mala fide and arbitrary and set aside the order and restore the order of the applicant.
