SHC seeks comments on petition filed by M/s Glacier Int’l challenging VR No 1452/2020

KARACHI: The Sindh High Court (SHC) directed customs officials to file their para wise comments on next date of hearing on a constitutional petition filed by M/s Glacier International challenging valuation ruling 1452/2020 and seeking release order for its imported consignment of fleece fabric.

On 31 August 2020, a two-member bench heard the constitutional petition.

During the hearing, counsel for the petitioner stated that petitioner has imported a consignment comprising fleece fabric from China and filed goods declaration, however, the appropriate officer has not accepted with the declared transactional value and arbitrary assessed the values on the basis of valuation ruling no 1452/2020 which was challenged before the DG Valuation.

He further submitted that petitioner claimed that the declared transaction invoice value under section 25-A of the customs act, 1969, the price of which is actually paid or payable to the seller.

He argued that denial of the provisional release of consignments by the customs officials are contempt of the orders passed by this court in Danish Jahangir case.

Citing chairman FBR, collector of Customs Appraisement West/ East/ PMBQ and DG Valuation as respondents, petitioner pleaded the court to declare that the denial of declared transaction value under section 25A of the customs act, 1969 is arbitrary and illegal to the customs act, 1969.

He further pleaded the court may to declare that the impugned valuation ruling without following the sequential method laid down under section 25 of the customs act, 1969 is illegal and contrary to the provisions of the customs act, 1969 and direct them to issue delay and detention certificate for waiver of demurrage and detention charges.
