KARACHI: A two-member bench of the Sindh High Court (SHC) headed by Justice Irfan Sadat Khan issued notices to the customs officials and deputy attorney general and directed them to file their respective para wise comments on a constitutional petition filed by M/s H.A Industries North Karachi, North Karachi Industrial Area.
On 17 March 2022, during the hearing, Raisul Hassan advocate appeared on behalf of the petitioner and argued that matter is an emergency basis therefore, court may grant his urgent application, learned counsel further states that the petitioner apprehended the respondents with the request to reduce the container detention charges but they did not pay any heard to such request.
He also states that the delay detention issued to withhold the shipment is illegal.
After the hearing, court granted his urgent application and called comments from respondents for next date of hearing.
Earlier, counsel argued his constitutional petition that on Nov 06, 2021 the shipment was come from UAE and said shipment was lying at Pakistan International Terminal PICT being the respondent party demanded huge rent amount of Rs, 1700,000 and 150 dollars per day.
He added that the petitioner apprehended to the respondent’s party with request to reduce the containers detention charges but respondent did not take any respond.
Citing Chairman Federal Board of Revenue, , Collector of Customs Port Muhammad Bin Qasim, PICT Terminal West Wharf Karachi as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.
He pleaded the court to restrain them from recovery of above mentioned illegal amount as well as restrain them from taking any adverse action against the petitioner till final order in this petition.
