KARACHI: A two-member bench of the Sindh High Court (SHC) directed customs officials and deputy attorney general of Pakistan to file their respective para wise comments on a constitutional petition filed by M/s Mian Shafiq Business International seeking release order for imported tyres & tubes.
On 25 March 2022, during the hearing, counsel for the petitioner argued that petitioner is engaged in the lawful business, import, whole sale and retail trade of tyres & tubes of various categories including dampers, constructions & mining concrete mixers & international handling vehicles etc
He argued that during the course of his business, petitioner imported numbers of consignments of assorted tyres & tubes with flaps of various size and after fulfilment of all legal formalities, filed goods declaration according to law, however, he was informed by the customs officials that the same has been stopped, seized by the customs officials due to alleged mis-declaration and disputed valuation.
Citing Chairman Federal Board of Revenue, Secretary Revenue Division, Chief Collector of Customs Appraisement South, Collector Customs Appraisement East and others, as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
Counsel further pleaded the court may direct them to release the petitioner’s present consignment and future as well. He further pleaded the court to restrain them from taking any adverse action against the petitioner till final order in this petition.
