SHC seeks comments on petition filed by M/s Raim Enterprises against detention of imported consignments

KARACHI: A division bench of the Sindh High Court (SHC) directed customs officials to make sure filing their para wise comments on a constitutional petition filed by M/s Raim Enterprises against detention of its imported consignments of canned pie filling topping assorted type quantity of 15, 993 kg from USA.

On 8 December 2020, during the hearing, counsel for the petitioner stated that in the normal course of business, the petitioner being active importer, exporter, wholesaler & distributors company, imported consignment of canned pie filling topping assorted type quantity of 15, 993 kg from USA, which declared its true, complete & correct particulars of such imported goods at value of US$ 9, 116.

He further argued that during the examination staff of the Collectorate contentions, that the petitioner is mis-declared the value, it is further informed that at the time of physical examination of the imported goods, verbally informed that higher value of invoice has been found, for US$ 46, 960 net weight 43, 680 kg and without lawful authority seized the same.

Citing chairman FBR, collector of customs Appraisement East as respondents, petitioner pleaded the court to direct customs officials to provisional release the consignments of the petitioner, under section 81 of the customs act, 1969 the petitioner will be suffered because goods are deto-rate his value day by day and facing heavy demurrage & detention charges, therefore, the petitioner is ready to submit solvent surety against the different amounts of duty and taxes as well as fine & penalty amounts for square the same.

He further pleaded the court to restrain the respondent from carrying out assessment of imported goods on the basis of the illegal found invoice, the petitioner will be suffered and not in cash the security amounts, till final disposal of the matter by the independent authority.
