KARACHI: A two-member bench, comprising Justice Shafi Muhammad Siddiqui and Justice Agha Faisal directed customs officials to make sure filing their respective para wise comments on a constitutional petition filed by M/s Pakistan Steel Imports Company and MAC Steel Corporation against detention of imported consignment.
On 11 October 2021, during the hearing, Zain Jatoi Advocate for petitioners, M Khalid Dogar and Imran Ali Mithani advocates for customs department and Kafeel Ahmed Abbasi Deputy Attorney General of Pakistan appeared before the court.
Counsel for the petitioners argued that petitioners are lawful importer of secondary quality steel products and during the course of its business; petitioner imported the same and filed goods declaration according to law, however, customs officials have denial the same and denial the same actual declared transaction value without assessing any cogent and plausible reasons.
Citing Chairman Federal Board of Revenue, Collector of Customs Port Muhammad Bin Qasim, Collector of Customs Appraisement West, Collector of Customs Appraisement East as respondents, petitioners pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court to directed them to release above-mentioned imported consignment on provisional release immediately and restrain them from taking any adverse action against the petitioners till final order in this petition.
