KARACHI: The Sindh high court (SHC) has issued notices to tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by Adnan, seeking release order of his non-duty paid Toyota Hiace Van bearing registration number BMB-081 (Quetta) impounded by authorities of anti-smuggling squad Larkana.
A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain, heard the petition.
Earlier, counsel for the petitioner stated that it was reported by the assistant collector model customs collectorate Hyderabad that an information received by the anti-smuggling squad Sukkar that a non-duty paid vehicle Toyota Hiace Van bearing registration number BMB-081 (Quetta) was seen plying on the route Larkana Sukkar.
According to the prosecution, a team was organized by anti-smuggling squad on January 29, 2013 to impound the vehicle. The team examined the vehicle and found that the chassis number of the said vehicle was tampered. Therefore, a case was registered and referred to the collector adjudication which ordered to impound the vehicle on March 19, 2013.
Later, the petitioner filed an appeal before the customs appellate tribunal Karachi which ordered the release of the vehicle on January 26, 2016. However, the respondents refused to hand him over the vehicle.
Citing Sectary Ministry of Finance, The Collector of Customs Adjudication, Quetta at Hyderabad, The Collector of Customs Hyderabad and others as respondents, petitioner pleaded the Sindh High Court that the act of the respondents is illegal and unlawful. He also pleaded the SHC may direct the respondents to release his vehicle.
