SHC seeks final arguments on petition filed by M/s S.N Company

KARACHI: The Sindh High Court (SHC) on Thursday directed parties to make sure to file their comments on a constitutional petition filed by M/s S.N Company seeking restoration of its sales tax return number suspended by customs department, a two-member bench heard the matter.

During the hearing, counsel for the petitioner submitted that it is engaged in the lawful manufacturing of paper tube and sale/ supply to various clients which are textile industries. On March 28, 2018 the commissioner Inland Revenue Zone-V, RTO-III issued a show cause notice which the reason of suspension has been mentioned illegally, unlawfully, claimed/ adjustable input sales tax of Rs295,435 during the period of July 2013 to June 30, 2017. Counsel argued that respondent also suspended its sales tax return number without fulfilling legal procedure.

Citing Chairman Federal Board of Revenue, commissioner Inland Revenue Zone-V, RTO-III as respondents, petitioner pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary, he also pleaded the court to direct them to restore its sales tax return number and restrain them from taking any coercive action against the petitioner.
