KARACHI: A two-member bench of the Sindh High Court (SHC) on Monday directed customs officials to file their final comments on a constitutional petition filed by M/s F.A.S Enterprises seeking release order of its consignment of optical frames, wrist watches and other miscellaneous goods detained by customs officials.
During the hearing, counsel for the customs department sought further time to file their comments; therefore, the court adjourned the matter.
Earlier, counsel for the petitioner stated that petitioner imported a consignment of assorted items including optical frames, wrist watches and other miscellaneous goods and filed goods declaration (GDs) dated May 5, 2018 declaring the consignment, strictly as per import documents and at their transaction value.
Counsel further argued that in addition to aforesaid consignment imported by the petitioner, respondents also detained two more consignments, consisting of similar miscellaneous goods and detention/hold of all three consignments is illegal and tainted with malice and greed.
Counsel argued that detention of the petitioner’s goods by the respondents is altogether illegal, discriminatory and in excess of jurisdiction conferred under the law.
Citing Secretary Revenue Division, Chairman Federal Board of Revenue, Director Directorate of Intellectual Property Rights, Deputy Director Directorate of Intellectual Property Rights and Collector of Customs Collectorate Port Muhammad Bin Qasim as respondents, petitioner pleaded the court to declare the act of the respondents as illegal, mala fide and arbitrary.
He also pleaded the court to direct them to release of its consignments immediately and restrain them from taking any coercive action against the petitioner.
