KARACHI: The Sindh High Court (SHC) has sought comments from Customs Collector Agha Shahid Majeed Khan, Additional Collector Umer Shafique and Deputy Collector Nafees Ahmed of Model Customs Collectorate Hyderabad on a contempt application filed by M/ s Fuel Traders, seeking compliance order of the SHC for releasing its 40,000 liters LDO.
A two-member bench, comprising Justice Muhammad Iqbal Kalhoro and Justice Khadim Hussain M Sheikh, was hearing the application. During the hearing, Deputy Collector of Customs, Deputy Collector Nafees Ahmed sought time to submit para wise comments on contempt application; therefore, the court granted him time and adjourned the hearing for August 11, 2016.
Earlier, counsel for the petitioner stated that petitioner is doing business of domestic trade of furnace oil, SKO,LDO,HSD etc, petitioner being bona fide purchaser made domestic purchase of goods i.e 40,000 liters LDO obtained from breakable marine ships from the registered supplier M / S Huk Trading Co, a common oil tanker being registration no K 8594 was hired by the petitioner on freight for transportation of its goods within the country from Karachi, but during the transportation on Jan 01,2016 ,the officers of the customs authorities intercepted the conveyance within the limits of Hyderabad and detained the goods along with transporting conveyance and the driver and cleaner were taken into the illegal confinement without adopting any legal procedure.
According to the petitioner, it filed a constitution petition before SHC and court had directed the respondents to release its good, however, when petitioner approached the concerned authority for compliance the court order, they denied and it was informed that goods were being auctioned.
Citing above respondents, Petitioner pleaded the SHC may start contempt proceedings against the contemptuous.
