SHC seeks remarks on petition filed by M/s A&S Express for release of imported goods

KARACHI: The Sindh High Court (SHC) directed customs authorities to file their respective para wise comments on a constitutional petition filed by M/s A&S Express seeking release order for imported consignment of hydraulic parts boosters, hydraulic c/b master cylinder, hydraulic pump cartridge, hydraulic turbo kits, hydraulic turbo diaphragm worth of US$ 27420 from China.

On 9 December 2020, during the hearing, counsel for the petitioner stated that petitioner imported a consignment of hydraulic parts boosters, hydraulic c/b master cylinder, hydraulic pump cartridge, hydraulic turbo kits, hydraulic turbo diaphragm worth of US$ 27420 from China dated June 18, 2020 and filed goods declaration according with law.

He further submitted that consignment got examined physically and the examination staff reported discrepancy in part number (the actual part number/ specification of item no I hydraulic clutch booster are printed on instant/ retail packing of the goods against the stamping inaccurate trano crane parts on shipping the stamping cartoons and catalogue is also different, these parts are for automotive Hino Afu dumper, light trucks, of Hino/Nissan/ Isuzu and for crane lorries.

He argued that that declared description is hydraulic booster for crane where during physical examination automotive hydraulic clutch booster for HTV which attract higher rate and show cause notice was issued to the petitioner, consequently, the case adjudicated vide order-in-original, thereby ordered that complete the assessment automotive hydraulic clutch booster under appropriate PCT heading 8413.5000 chargeable to customs duty @20% and recover the leviable duty and taxes, a penalty of Rs50,000 is also imposed, upon the petitioner.

Counsel has said that the petitioner approached the customs officials for implementation of order-in-original, despite of various requests as consignment is lying at port incurring heavy demurrages and detention charges same has been accumulated but the respondent is reluctant not to release the consignment.

Citing Chairman FBR, chief collector of Customs South and Collector of Customs Appraisement East as respondents, the petitioner pleaded the court may direct them to be implemented and consignment is liable to be released to the petitioner.
