KARACHI: The Sindh High Court (SHC) issued notices to the customs officials and deputy attorney general on a petition filed by M/s H.H Enterprises against enhancement of valuation of its imported consignments.
While hearing of the petition, on March 11, 2020, a two-member bench, headed by Justice Aqeel Ahmed Abbasi directed them to file their respective para wise comments on next date of hearing.
During the hearing, counsel for the petitioner stated that in the normal course of business, the petitioner is engaged in lawful imported their respective consignments regularly of 18,900 kg Synthetic Rubber NBR 6240 from South Korea against the mutual agreement for US$ 1.650 per kg, total invoice value for US$ 31, 185,00 and 18,500 kgs Natural Raw Rubber RSS from Sri-Lanka dated Feb 25, 2020 and filed goods declarations accordance with law.
He further submits that however, without consider the bank transaction (L/C) without consider the current market value is US$ 1.55 to US$ 1.65, illegally denying the acceptance of transaction value under section 25(1) of the customs act, 1969, customs officials refused to clear the imported goods on declared value for US$ 1.55 to US$ 1.65 and assessed the goods declarations on enhance value for US$ 2.50 to US$ 2.75.
Citing Sectary Revenue Division, Chairman FBR and The Collector of Customs Appraisement West/ East as respondents, petitioner pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court may directed them to release his consignments immediately and issue the delay and detention certificate, in the best interest of justice and restrain them from taking any coercive action against the petitioner till final order in this petition.
