SHC seeks reply from customs officials on petition filed by M/s Black Gold Industries

KARACHI: A two-member bench of the Sindh High Court (SHC) headed by Justice Irfan Sadat Khan directed customs officials to file their respective para wise comments on a constitutional petition filed by M/s Black Gold Industries against detention of its imported consignment of iron & steel coil (secondary quality).

On 2 April 2022, during the hearing, Aqeel Ahmed Khan advocate for petitioner, Kafeel Ahmed Abbasi, deputy attorney general of Pakistan appeared before the court, counsel for the petitioner argued that issue involved in instant petition covered by the decision given in Special Customs Reference Application No 113/ 2019 and copy of the same has been given to DAG as well as Muhammad Khalil Dogar for the respondents who seeks time to go through the same.

After the hearing, court directed parties to file their respective para wise comments for next date of hearing.

Earlier, counsel for the above-mentioned importer argued that petitioner is engaged in import of different items, through its professional excellence, hard work and dedicated customer service, the petitioner has developed a substantial clientele all over the country.

Counsel argued that during the business, petitioner imported above mentioned goods and filed goods declaration according to law, however, petitioner was informed that the goods have been seized and same are being valued under the garb of valuation ruling no 1213/2017 without considering facts.

Citing Sectary Ministry of Finance, Chairman Federal Board of Revenue, Collector of Customs Appraisement East, Collector of Customs Appraisement West, Collector of Customs Appraisement Port Muhammad Bin Qasim as respondents, he pleaded the court to direct them to release the above-mentioned goods and restrain them from taking any adverse action against the petitioner till final order in this petition.
