KARACHI: The Sindh High Court (SHC) directed customs officials to file their para wise comments on a constitutional petition filed by proprietor Sajid Iqbal of M/s Al-Muntaqim International Services against detention of imported consignment of 289 cartons of textile material laces, yarn and some machine parts, etc.
On March 18, 2020, a two-member bench, headed by Justice Aqeel Ahmed Abbasi was hearing the matter.
During the hearing, counsel for the petitioner stated that petitioner is a law abiding and peace loving citizen and is being engaged in the business of import and export since last five years and enjoying their marvelous and excellent reputation along their competitors.
He further submitted that petitioner imported 289 cartons of textile material laces, yarn and some machine parts, etc from China and filed goods declaration according with law.
He said that however, petitioner being aggrieved and dissatisfied with the impugned show cause notice dated Feb 4, 2020 passed by the respondents, whereby, they illegally unlawfully and unauthorized, confiscated the consignment of the petitioner with a fake and fabricated allegation that the said consignment was imported from India, in fact the said consignment which contained 289 cartons of textile, laces, yarn and some machine parts etc and the same was imported from China.
Citing chairman Federal Board of Revenue, secretary Revenue Division, Appraisement West and others as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court may direct them to release his consignment immediately and restrain them from taking any coercive action against the petitioner till final order in this constitutional petition.
