During the hearing, counsel for the petitioner stated that it is engaged in the lawful business/import/sales of food items and imported a consignment of food items and submitted goods declaration according with law.

Counsel argued that it was informed by the customs officials that its consignment was held due to disputed valuation and will be released when its pay disputed valuation.

Citing Secretary Revenue Division, chairman Federal Board of Revenue, Director General Valuation, Chief Collector of Customs Appraisement as respondents, he pleaded the court to direct the respondents to provincially release the consignment of the petitioner after collection of duties and taxes based on the transactional value of such goods declared by the petitioner.

He also pleaded the court to restrain them from taking any coercive action against the petitioner till final order of this petition. After the hearing, court directed customs authorities to make sure filing their comments on next date of hearing.
