Faisalabad Customs Intelligence collects evaded tax, release consignments

SHC seeks reply on petition filed by M/s Waris Sharif & Co for release of consignment

KARACHI: The Sindh High Court (SHC) issued notices to the customs department and deputy attorney general of Pakistan on a constitutional petition filed by M/s Waris Sharif & Co seeking release order of imported consignment of PVC Clear transparent sheet flexible.

On January 28, 2019, while hearing the petition, a two-member bench, headed by Justice Aqeel Ahmed Abbasi directed them to file their para-wise comments on next date of hearing.

During the hearing, counsel for the petitioner stated that petitioner imported consignments of PVC clear transparent sheet flexible @$1.31 per kg total worth $24, 962.18 from China and PVC clear transparent sheet @$1.31 per kg total worth $25,001.87 from China dated January 11, 2019 and filed goods declaration and paid customs duty and taxes amounting to Rs1,969,098 and Rs1,972,224.

He further submitted that respondents have assessed the item @$1.60 per kg as per Valuation Ruling 1317/2018 dated 17/08/2018, meanwhile, the respondents during the pendency of revision petition was allowed the release of past consignments provisionally under section 81 of the customs act, but now respondents refused to release the goods.

Citing chairman Federal Board of Revenue, chief collector of Customs Appraisement South, Director General of Valuation and others as respondents, petitioner pleaded the court to declare that act of the respondents as illegal, mala fide and arbitrary.

He further pleaded the court may declare that the respondents are under obligation to allow the clearance of duty paid goods under section 83 of the customs act, without further delay and allow assessment under Section 81 of the Customs Act, 1969 and direct them to issue delay, detention which are in pipe line.
