KARACHI: The Sindh High Court (SHC) has issued notices to tax authorities and deputy attorney general of Pakistan on a constitutional petition filed by M/s Riaz Trade Enterprises, challenging Valuation Ruling No 908/2016, which enhances additional duty and taxes on mobile phones’ accessories.
While hearing the petition, a two-member bench comprising Justice Munib Akhtar and Justice Saeeduddin Nasir directed them to file their respective para-wise comments on the next date of hearing.
Earlier, counsel for the petitioner stated that petitioner is engaged in the lawful import of mobile phone accessories from various sources around the world, including China and Vietnam. It has imported a consignment relating to mobile accessories including charger and hand-free and filed goods declaration as per transaction value which were not accepted by the officials of the custom.
According to the petitioner, goods were arbitrary assessed on the enhanced value on the basis of impugned Valuation Ruling No 908/2016 dated August 12, 2016, which issued in the manner which is contrary to law and regulations.
Citing Federal Board of Revenue (FBR) chairman, Custom Appraisement-West collector, Customs Valuation director general and director as respondents, the petitioner pleaded the SHC may declare the demand of the additional duty and taxes without following the procedure laid down in section 25(A) is illegal void and of no legal effect.
