SHC suspends notice of raiding Riaz Ahmad’s business place

KARACHI: The Sindh High Court (SHC) suspended the impugned notice of conducting a raid at business place of the Riaz Ahmed Razzak (petitioner)) and directed the tax authorities to file their comments on June 08, 2016 on a petition seeking release of equipments and documents, which were taken by the officials.

A two-judge bench, comprising Justice Munib Akhter and Justice Abdul Malik Gaddi, heard the petition.

Earlier, the petitioner’s counsel stated that petitioner was engaged in the business of construction and paying all liabilities regularly. However, Inland Revenue Intelligence and Investigation director general and director issued a notice on May 30,2016 informing the placement of seven officers at business place of the petitioner. Same day seven persons raided the premises of the petitioner and took away all the equipment and documents of the petitioner without giving him a receipt.

According to the petitioner, the officials concerned had demanded bribe from him when he asked them to give him a receipt. The counsel argued that raid was completely unlawful, mala fide.

Citing Revenue Division secretary, IR Intelligence DG and director, IR chief commissioner as respondents, the petitioner pleaded the SHC to set aside impugned notice and restrain the respondents from taking any coercive action against it.
