Show cause notice suspended by SHC against Fateh Textile Mills Ltd

KARACHI: An appellate bench of Sindh High Court (SHC) comprising Justice Munib Akhtar and Justice Arshad Hussain Khan suspended a show cause notice issued to the Fateh Textile Mills Ltd till May 09.

The bench earlier heard Afzal Awan advocate counsel for applicant in a Special Customs Reference Application (SCRA) impugning a judgment by Special Customs Appellate Tribunal.

They are coercing the recovery after the judgment by the tribunal while SCRA is pending before SHC. The show cause notice was issued after a delay of years, hence mala fide, submitted the counsel.

The bench made a number of queries from Kashif nazeer advocate appearing for the respondent side and pointedly asked that when contravention was detected and reported. He was also asked to read out the relevant section of the law under which petitioner/applicant was asked to show cause.

As the counsel for respondents was unable to satisfy the court, the bench put of hearing till May 09 while suspending the impugned demand letter asking the counsel to find out dates and look into question of time.
